Terms & Conditions

Part 1: General Terms (all services)

1. Scope. Apex Lighting ("Apex") will provide the design, installation, maintenance and/or removal described in your quote. The quote lists products, footage, pricing and whether Part 2 (Holiday & Seasonal) or Part 3 (Permanent) applies. If the quote and this agreement conflict, the quote controls. Changes you request after approval are added at our standard rates, and we confirm the price first.

2. Your Responsibilities. Provide clear, safe access to the property, rooflines and outdoor outlets at scheduled times, with gates unlocked and pets secured. Tell us about known problems such as loose shingles, weak gutters, damaged siding or faulty wiring. Provide working outdoor power; electricity for the display is your cost. Apex does not perform hard-wired electrical work, so any new outlet or circuit must be installed by a licensed electrician at your cost. Obtain any HOA or landlord approval, and check whether fasteners affect any roofing, siding or gutter warranty you have. For your safety, do not climb on the roof or ladders to adjust the display.

3. Scheduling & Weather. Our work may include walking on the roof and, where wiring can't be routed through an attic, running wires over the roofline. We will not work in unsafe conditions (high winds, rain, snow, ice) or on areas we judge structurally unsound. Weather delays are rescheduled at the next available date at no change in price.

4. Payment. A 50% deposit is due when you approve your quote. It covers materials and reserves your place on our schedule. The balance is due within 14 days after installation is complete, unless a payment plan is written on your quote. We accept check and debit/credit card; paying by card authorizes Apex and its payment processor to charge the card on file for amounts due under this agreement. Quotes are valid for 60 days. Balances not paid within 14 days after installation may incur a late fee, and we may pause service, decline renewal-year installations or remove leased equipment until the account is current.

5. Cancellations & Refunds. You may cancel for a full refund within three business days of approving your quote. After that, materials have usually been ordered. Your refund is your deposit minus labor already completed and the cost of materials that can't be reused, such as aluminum channel ordered in your home's trim color. Multi-year holiday agreements also follow Section 12.

6. Liability. We take every precaution to protect your property. We are not responsible for pre-existing conditions (such as loose shingles, weak gutters, brittle siding or electrical issues), damage caused by structural weakness or deteriorated materials, power outages or tripped breakers, or delays caused by events beyond our control. Any accidental damage directly caused by our work will be reported right away and addressed in good faith. Except for damage caused by our negligence, our total liability is limited to the amount you paid for the service involved. Apex carries general liability insurance, and commercial clients may request a certificate of insurance.

7. Photos & Video. Your display deserves to be shared. You agree we may photograph and record it for our website and social media without showing your house number, street or anything that identifies your address. To opt out, tell us in writing before installation.

8. Communication & Privacy. You agree that we may contact you by phone, text and email about scheduling, service, billing and renewals. Reply STOP to opt out of non-essential texts. We use your information only to provide and bill for your service and never sell it. See our Privacy Policy.

9. General. This agreement is governed by Minnesota law, and disputes will be handled in Olmsted County, Minnesota. This agreement and your approved quote are our complete agreement; changes must be in writing, including email or an approved Jobber quote. If any part is found unenforceable, the rest still applies. Approving your quote, in Jobber or in writing, means you accept this agreement.

Part 2: Holiday & Seasonal Lighting

Applies to Classic Christmas Lights, RGBW C9 bulbs, and InvisiLights on Invisi-Clips installed for the season and removed afterward.

10. Leased Equipment. Unless your quote says it is a purchase, all lights, cords, clips and controllers remain Apex property, leased to you for the agreed season(s). Leased equipment that is kept, removed or damaged by causes other than normal wear (such as storms, pets, vandalism or changes made by others) may be billed at repair or replacement cost.

11. Installation & Maintenance. Lights are mounted with clips made for gutters and shingles; on some surfaces we may use tape, hot glue or staples where needed, and approving your quote means you agree to these methods. Maintenance is included for the season: if a bulb, strand or timer fails, contact us and we will fix it at no charge. No one other than Apex may move, alter or repair the display; changes by others void the included maintenance, and repairs we then make are billable.

12. Multi-Year Agreements (2 or 3 years). Your quote lists your term, yearly price, discount and payment schedule. Payment for each renewal year is due August 1 and, if you have a card on file, will be charged on that date; we will remind you before charging. To cancel a remaining year, notify us in writing before August 1 of that year. Payments for completed seasons are not refunded, and if you cancel early you agree to repay the multi-year discount you received for completed seasons. Your agreement ends after its final season and does not renew automatically.

13. Removal. Displays are removed after the holiday season. We fit your removal into our schedule and keep you updated through Jobber when it's booked.

Part 3: Permanent Lighting

Applies to InvisiLights installed in aluminum channel, and to InvisiLights on Invisi-Clips that you purchase to leave up year-round.

14. Ownership. Permanent lighting is a purchase. Ownership of the lights, channel and controller passes to you when your balance is paid in full.

15. Installation. Aluminum channel is color-matched to your trim and fastened with self-tapping screws on aluminum soffits, or screws suited to wood soffits where needed; approving your quote means you agree to this mounting method. Channel installations are generally scheduled outside the October–January holiday season.

16. Warranty. As an authorized InvisiLights dealer: Aluminum channel systems include the manufacturer's lifetime warranty on InvisiLights products and a 5-year Apex labor warranty from the installation date. Invisi-Clip systems (no channel) include a 3-year warranty from the installation date. Upgrade to a full channel installation within one year and your system receives the lifetime product and 5-year labor warranty, with labor coverage starting on the upgrade date. Warranties do not cover damage from storms, falling ice, impact, pests, roof or gutter work by others, or changes made by anyone other than Apex. Service outside the warranty is billed at our standard rates.

17. Pre-Lien Notice.

(A) ANY PERSON OR COMPANY SUPPLYING LABOR OR MATERIALS FOR THIS IMPROVEMENT TO YOUR PROPERTY MAY FILE A LIEN AGAINST YOUR PROPERTY IF THAT PERSON OR COMPANY IS NOT PAID FOR THE CONTRIBUTIONS.

(B) UNDER MINNESOTA LAW, YOU HAVE THE RIGHT TO PAY PERSONS WHO SUPPLIED LABOR OR MATERIALS FOR THIS IMPROVEMENT DIRECTLY AND DEDUCT THIS AMOUNT FROM OUR CONTRACT PRICE, OR WITHHOLD THE AMOUNTS DUE THEM FROM US UNTIL 120 DAYS AFTER COMPLETION OF THE IMPROVEMENT UNLESS WE GIVE YOU A LIEN WAIVER SIGNED BY PERSONS WHO SUPPLIED ANY LABOR OR MATERIAL FOR THE IMPROVEMENT AND WHO GAVE YOU TIMELY NOTICE.
